These Terms of Service ("Terms") govern your use of Oraculum Signals ("the Service"), operated by Marc Lloyd Adams trading as Development AI Tools (ABN 71 511 914 959), located in Australia ("we", "us", "our").

By accessing or using the Service at oraculumtrader.com, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Oraculum Signals is a market data dashboard that scans cryptocurrency and forex/commodities markets and presents technical indicator signals. The Service is provided on a subscription basis with multiple tiers (Free, Basic, Premium, Max).

2. Not Financial Advice

Oraculum Signals does not provide financial advice, trading recommendations, or investment guidance. All signals, indicators, scores, and data presented by the Service are for informational and educational purposes only.

Signals highlight assets that may be worth investigating based on technical indicator confluence. They are not instructions to buy, sell, or trade.
Past indicator performance does not guarantee future results.
You are solely responsible for your own trading and investment decisions.
You should consult a qualified financial advisor before making any trading decisions.
We are not a licensed financial services provider and do not hold an Australian Financial Services Licence (AFSL).

3. Accounts

You may create an account using GitHub OAuth or email/password. You are responsible for maintaining the security of your account credentials. You must provide accurate information and must not create accounts for fraudulent purposes.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behaviour.

4. Subscriptions & Billing

Paid subscriptions are billed monthly or annually through Stripe.
Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
You can cancel your subscription at any time through the Manage Subscription option in your profile menu. Cancellation takes effect at the end of the current billing period.
Prices are listed on the pricing page and may change with 30 days' notice to existing subscribers.

5. Refund Policy

Subscriptions are non-refundable. When you cancel, you retain access to your paid tier until the end of your current billing period. No partial refunds are issued for unused time.

6. Acceptable Use

You agree not to:

Scrape, copy, redistribute, or resell data from the Service
Attempt to gain unauthorised access to other users' accounts or our systems
Use the Service to manipulate markets or engage in illegal activity
Share your account credentials or subscription access with others
Interfere with or disrupt the Service or its infrastructure

7. Availability & Data Accuracy

We aim to provide reliable, continuous service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Market data is sourced from third-party exchanges (Bitget, OANDA) and is provided as-is. We do not guarantee the accuracy, completeness, or timeliness of any data or signals. Signal data for free-tier users may be delayed.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or trading losses, whether direct or indirect, arising from your use of the Service.

Our total liability for any claim arising from your use of the Service is limited to the amount you paid us in subscription fees in the 12 months preceding the claim.

9. Intellectual Property

All content, code, design, and branding of Oraculum Signals is owned by us. Your subscription grants you a personal, non-transferable licence to access the Service for your own use. You may not copy, modify, or redistribute any part of the Service.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Australia.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
